GENERAL TERMS AND CONDITIONS

Article 1 – Definitions

CRUSH Studios BV, registered in the trade register of the Chamber of Commerce under number 92862578.

Participant/you: Anyone who has entered into an Agreement with CRUSH Studios to take lessons. Agreement: The Agreement between you as a Participant and CRUSH Studios for taking lessons, for example (but not limited to) a ‘Membership’, ‘Class Trial Pack”, ‘Single Class’, or ‘Package’, as you can book on the Website or through the CRUSH Studios app. Lesson: Any (individual or group) lesson given by or on behalf of CRUSH Studios. Credit: The credit you purchase via the Website or App to book and/or attend a lesson within the specified duration/validity. Studio: The studio where the lesson takes place as indicated on the Website (Zijlweg 1 in Haarlem). Website: www.crushstudios.nl App: ‘CRUSH Studios’.

Article 2 – Applicability of these terms

These General Terms and Conditions apply to every offer and every booking or Agreement between a Participant and CRUSH Studios for taking lessons.

By entering into an Agreement with CRUSH Studios, you agree to these General Terms and Conditions.

CRUSH Studios BV reserves the right to change these General Terms and Conditions. The applicable version of the terms is the version available on the Website.

These General Terms and Conditions are drawn up in Dutch and English. In case of a difference in interpretation between the versions, the Dutch version is decisive.

Article 3 – The Agreement (Membership, Class Trial Pack, Single Class, etc.)

We offer lessons in various ways, such as through a ‘Membership’, ‘Class Trial Pack’, ‘Single Class’, or ‘Package’, see the options on the Website or App and the associated conditions. Check those conditions carefully!

Your rights as a Participant under the Agreement with CRUSH Studios are strictly personal and non-transferable.

To enter into an Agreement and take lessons, you must create an account via the Website/App.

All Agreements are final: once purchased lessons, whether via a ‘Membership’, ‘Trial Pack’, ‘Package’ or otherwise, will not be refunded.

The Agreement starts on the date you booked via the Website/App and applies only for the indicated duration/validity: this is fixed and cannot be shortened, extended, or temporarily suspended. Interim cancellation is not possible. You are not entitled to a refund if you cannot take the remaining lessons within the specified duration.

Before a lesson, you must register as a Participant via your account on the Website/App. Without registration, you have no right to participate in a lesson.

CRUSH Studios BV reserves the right to change the offer of lessons, the schedule, and/or the (location of the) studio and/or prices. The applicable offer, schedule, location, and current prices are always listed on the website.

In case of insufficient interest, we are entitled to cancel the lesson up to the start of the lesson. You will then retain your credit for the lesson.

Only in exceptional cases and in consultation with us and upon presenting a written doctor’s note, can you, if you are seriously ill, injured, or pregnant, suspend the Agreement temporarily.

Article 4 – Cancellations / 24-hour cancel policy / NO SHOW

Always cancel your lesson if you unexpectedly cannot come. Log into your account on the Website or via the App. On the right side, you will see a black icon. Click on it and go to ‘My classes’ and click ‘cancel’ behind the booked lesson (at least 24 hours in advance), or ‘late cancel’ (if the lesson starts within 24 hours).

You can cancel up to 24 hours before the start of the lesson free of charge. You will then retain your Credit for the lesson. If you cancel within 24 hours before the start of the lesson, this counts as a late cancellation and you lose your Credit for the lesson; you will not receive a refund. So make sure to cancel on time!

You cannot change the lesson/time within 24 hours before the start of the lesson.

If you have not canceled a booked lesson and you are not present (No Show), you will pay a No Show fee of 10 euros. Always cancel your lesson if you are unable to attend.

Article 5 – Waitlist

If the lesson you want to attend is fully booked, you can be placed on the waitlist. To be on the waitlist, you need a Credit in your account.

If a spot becomes available, you will automatically be added by the system up to 30 minutes before the start of the lesson. You will receive an email notification. Within 30 minutes before the lesson, we will contact you via phone or WhatsApp if you are added to the lesson and can participate. Always keep an eye on the waitlist status via your account.

If you are admitted to the lesson via the waitlist and you do not attend, you lose your Credit. So always check the waitlist status!

If you are on the waitlist and do not want to attend, always remove yourself from the waitlist. This is to prevent you from automatically being admitted when a spot becomes available and losing a Credit.

Article 6 – The Lesson

The Studio opens 10 minutes before the lesson starts. The lesson starts exactly on time. If you are late and the lesson has already started, you cannot participate, so be on time.

If you are a first-time participant, make sure to arrive at least 10 minutes early for a (safety) instruction on the machine.

It is mandatory to wear appropriate, clean sportswear during the lesson. Grip socks are also required. These grip socks are available for purchase at the studio.

CRUSH Studios reserves the right to refuse Participants if instructions are not followed and/or in case of improper behavior in the Studio.

Article 7 – Risk and Liability

Attending a lesson at CRUSH Studios is entirely at your own risk.

You are required to inform the trainer before, during, and/or after the lesson if you have any limitations, illnesses, or injuries that we need to be aware of, or that may be necessary to know regarding the exercises. You are responsible for timely and fully reporting any (physical) condition we need to know about for a safe lesson.

CRUSH Studios and/or its employees are not liable for material and/or immaterial damage as a result of an accident, injury, and/or damage during or related to the lesson.

CRUSH Studios and/or its employees do not accept liability for loss of and/or damage to your property in/around the Studio location.

CRUSH Studios and/or its employees do not accept liability for any damage resulting from the Website/App being (partially) inaccessible or due to the inability to log into your account.

If damage is caused to CRUSH Studios’ (and employees’) property or in/to the Studio due to fault and/or negligence by the Participant, the Participant is liable for this.
